Terms and Conditions

These booking terms and conditions govern the booking made by yourself ("you") via Go Granada ("We" or "Us") whose registered address is 125 Landguard Road, Portsmouth, Hampshire, PO4 9DS

These booking terms and conditions relate to the following "City Taster", "From East to West", "The Moor's Last Sigh", "Tapas Nights", "The Grand Gourment" "In the Footsteps of Gypsy", "Olive Oil Ole" "Creative Cookery" "A Painters Paradise" "The Garcia Lorca Experience" "Gardens of Granada" and Conference, Destination and Business Consultancy.

ACTING AS AGENT

Except where otherwise specified, Go Granada acts only as an agent in respect of all bookings we take and/or make on your behalf.

This includes (but is not limited to):-

  • Restaurants
  • Tapas Bars
  • Refreshments, Bars, and Terteria's
  • Entrance to Points of Interest, Museums, Gardens, Flamenco Shows
  • Arab Baths
  • Accommodation
  • Olive Oil Tasting
  • UPS Delivery Service
  • Painting Excursion
  • Tours, Talks or Instructive Classes delivered by Suppliers (Not Go Granada)
  • Transportation, (Rail, Vehicle, Air)

When we act as agent you can purchase the above items via ourselves as booking agent. This means your contract is with the supplier of the services. For example, in terms of the provision of accommodation, your contract is with the accommodation provider and so on.

You can purchase each item separately, and an individual price is payable per item. You may choose to book for example, a tour, a meal in a restaurant, and accommodation. The price charged in total for more than one booking will always equal the prices charged separately for each individual booking.

The supplier's terms and conditions may limit and/or exclude the supplier's liability to you. Copies of applicable conditions are available on request from the supplier.

ACTING AS PRINCIPAL

We act as Principal for these elements only. These elements include:-

  • Guided Tours (Provided by Go Granada)
  • Creative Cookery (Provided by Go Granada)
  • Conference, Corporate, and Dinners Organisation Services reasonable choice of subcontractor taking into account your instructions

This means that your contract in terms of the ("Principal Element(s)") is between us.

When we act as Principal by way of example, in respect of the Guided Tours and Creative Cookery, we act as principal in the provision of the service only. For example, our liability for Guided Tours is in respect of the information provided, and level of quality in respect of the Tour itinerary. We would not have any liability for example if you sustained an injury whilst walking around Granada on a Guided Tour.

Your booking for the above Principal Element(s) with us is subject to the Terms and Conditions below.

GENERAL

You are advised to read both the Supplier Terms and Conditions and these Terms and Conditions carefully prior to booking.

All arrangements are available to be purchased separately at the same price as they are when more than one booking is made. This means that any multiple bookings do not constitute a package as defined in the Package Travel, Package Holidays and Package Tours Regulations 1992.

By booking with /via us agree that:-

  • You have read the terms and conditions set out in this document and agree to be bound by these terms and conditions.
  • You and your party are over 18 years of age.
  • All persons under 18 years of age must be accompanied by a parent or guardian at all times.

1. Booking and payment

When you make a booking you guarantee that you have the authority to accept (and do if applicable) accept these booking conditions on behalf of your party.

In order to confirm your chosen arrangements, you must pay a deposit as required by us or the supplier of the arrangements in question (or full payment if booking within 6 weeks from the date the booking begins).

Your booking is confirmed and a contract between you and the supplier/ you and us will exist when:-

(a) We send your confirmation voucher on their behalf in respect of Agency Element bookings,
(b) We issue with a confirmation in respect of the principal element.

Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are correct.

If you have paid a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, where acting as agent we will notify the supplier who may cancel your booking and charge the cancellation fees set out in their booking conditions. See the Cancellation clause below for further details. Payment may be made by any of the following methods (i) by direct payment to my bank account (details available upon request) (ii) by cash payment.

Except where otherwise advised or stated in the booking conditions of the supplier concerned, all monies you pay to us for arrangements will be held on behalf of the supplier(s) concerned.

2. Prices

We reserve the right to amend the Principal Element advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices. Special note: changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking.

We will not amend the prices of the Supplier in relation to the Agency Element. The prices of the Agency Element of your booking will be dictated by the supplier in question.

3. Insurance

You must take out personal travel insurance for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs. Please read your policy details and keep your policy with you at all times.

4. Special requests

If you have any special requests (for example dietary requirements or room location), please let us know at the time of booking. We will pass on all such requests to the supplier in respect of the Agency Element, but we can't guarantee that they will be met and we will have no liability to you if they are not.

In respect of the Principal Element we will endeavour to facilitate your request however cannot guarantee that we will be able to do so. We will keep you updated as to the position of your special requests.

5. Changes and Cancellations by you

Any cancellation or amendment request must be sent to us in writing, by email, and will take effect on the day we receive it. Proof of posting is not proof of receipt; therefore you are advised to also confirm all changes by telephone. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that such requests will be met.

Amendments and cancellations of the Agency Elements can only be accepted in accordance with the terms and conditions of the supplier of your arrangements.

The supplier may charge the cancellation or amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the arrangements and will normally increase closer to the date of departure). In addition you must pay us an administration fee of £25 per person for any amendments to your bookings. You will be notified of the exact charges at the time of amendment or cancellation.

Where you make a cancellation in respect of the Principal Element of the booking, cancellation charges will be applicable.

6. Changes and Cancellations by the Supplier

We will inform you as soon as reasonably possible in respect of the Agency Element of the Booking if the supplier needs to make a significant change to your confirmed arrangements or to cancel them. We will also liaise between you and the supplier in relation to any alternative arrangements offered by the supplier but we will have no further liability to you.

If for whatever reason we are forced to change or cancel the Principal Element of the booking we will provide you with the option of a suitable alternative to accord with the rest of your itinerary.

7. Responsibility for your booking

As outlined above, the Principal Element of the contract will be with us, however the Agency Element is where we act as agent, and therefore in respect of the Agency Element the supplier's booking conditions apply.

As agent, we accept no responsibility for the actual provision of the arrangements.

Our responsibilities in respect of the Agency Elements outlined above are limited to making the booking in accordance with your instructions.

We accept no responsibility for any information about the arrangements that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the commission received by us on your booking (or the appropriate proportion of this if not everyone on the booking is affected). I do not exclude or limit any liability for death or personal injury that arises as a result of my negligence or that of any of my employees whilst acting in the course of their employment.

In respect of the Principal Element of your booking, we will perform using reasonable skill and care. Please note that it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. If we fail perform your Principal Element arrangements using reasonable skill and care, taking into consideration all relevant factors (for example following the complaints procedure as described in these conditions and the extent to which our acts or omissions affected the overall enjoyment of Principal Element), we will pay you reasonable compensation.

In respect of the Conference, Corporate, and Dinners Organisation Services our liability is limited to making reasonable choice of subcontractor taking into account your instructions.

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description which results from: -

the act(s) and/or omission(s) of the person(s) affected;
the act(s) and/or omission(s) of a third party not connected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or
An event which ourselves, our employees, agents or suppliers and subcontractors could not, even with all due care, have foreseen or forestalled.

The services and facilities included in your Principal Element will be deemed to be provided with reasonable skill and care if they comply with any local regulations which apply, or, if there are no applicable local regulations, if they are reasonable when compared to the local standards in practice.

Claims not falling under (a) above or involving injury, illness or death

The maximum amount we will have to pay you in respect of these claims is twice the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.

It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves and our supplier(s) strictly in accordance with the complaints procedure set out in these conditions.

Where any payment is made, the person(s) receiving it (and their parent or guardian if under 18 years) must also assign to ourselves or our insurers any rights they may have to pursue any third party and must provide ourselves and our insurers with all assistance we may reasonably require.

Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you; or (b) any business losses.

8. Complaints

In respect of the Agency Element of your booking the contract for your arrangements is between you and the supplier, any queries or concerns should be addressed to them.

If you have a problem in respect of the Principal Element of your booking this must be reported to us immediately. If you fail to follow this procedure there will be less opportunity for the supplier/ us to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced as a result.

If you wish to complain when you return home, write to the supplier in respect of the Agency Element of your Booking, or write to us in respect of the Principal Elements of your booking. You will see the Supplier name and contact details in any confirmation documents we send you. Any assistance in relation to the Agent Element of the claim provided by me will be given on a goodwill basis in my capacity as agent.

9. Accommodation, Restaurants and Services Ratings and Standards

All ratings or representations as to quality are as provided by the relevant supplier. These are intended to give a guide to the services and facilities you should expect from your accommodation, from the restaurant or service which you have contracted for. Standards and ratings may vary between suppliers. We cannot guarantee the accuracy of any ratings or representations given by our Principals.

10. Documentation & Information

All descriptions and content on our website or otherwise issued by me us is done so on behalf of the supplier(s) unless it is clearly stated "PRINCIPAL ELEMENT"

The information presented on behalf of supplier(s) is intended to present a general idea of the services provided by the supplier(s) in question. All services shown are subject to availability. If you require any further details, in respect of any accommodation or any other services please contact us providing details of the additional information needed.

11. Force Majeure

Force majeure means that I will not pay you compensation if we have to cancel or change your booking in any way because of unforeseeable circumstances beyond my control. These include for example, war, threat of war, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority, industrial dispute, natural or nuclear disaster, fire, adverse weather, sea and ice conditions.

12. Law and Jurisdiction

These Booking Conditions and any agreement to which they apply are governed in all respects by English law. Any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of England and Wales only.
